TERMS & CONDITIONS

Last updated: 22 October 2026

These Terms & Conditions apply to the website, quotations, goods and services supplied by MARKED. Branding & Signage, operated by Paris Godsell ABN 26760936930 (“MARKED.”, “we”, “us” or “our”).

By using our website, accepting a quotation, paying a deposit, instructing us to commence work or otherwise engaging us to provide goods or services, you agree to these Terms & Conditions.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

1. About MARKED.

MARKED. Branding & Signage provides vehicle branding, vehicle wraps, fleet branding, commercial signage, window graphics, shopfront signage, design, production, installation and related branding services.

2. Quotes and Estimates

Unless stated otherwise, our quotations are valid for 30 days from the date of issue.

A quotation is based on the information available to us at the time it is prepared, including measurements, photographs, artwork, vehicle details, site information and instructions supplied by you.

If the scope, measurements, artwork, materials, access requirements, installation conditions or other relevant circumstances change, we may provide a revised quotation or variation before carrying out the additional work.

Any estimate is an indication only. Where reasonably practicable, we will notify you before incurring costs materially above an estimate.

Prices are stated in Australian dollars and are inclusive or exclusive of GST as specified on the quotation.

3. Acceptance of a Quote

A contract is formed when you:

  • accept our quotation electronically or in writing;

  • pay a requested deposit;

  • instruct us to proceed with the work; or

  • otherwise clearly accept our offer.

The contract consists of:

  1. the accepted quotation;

  2. any written variations subsequently agreed between us; and

  3. these Terms & Conditions.

If there is an inconsistency, the specific terms shown on the accepted quotation will take priority over these general Terms to the extent of that inconsistency.

4. Deposits

We may require a deposit before artwork, materials, production or installation is scheduled.

The amount of any required deposit will be stated on the quotation.

A deposit may be used towards costs reasonably incurred in preparing for your project, including design work, ordered materials, outsourced production, booking costs and labour.

If you cancel a project after accepting a quotation, we may retain or recover from the deposit an amount reasonably reflecting work performed, materials ordered, commitments made and losses reasonably incurred as a result of the cancellation.

Any remaining balance of the deposit will be refunded where required.

Nothing in this clause limits any rights you may have under the Australian Consumer Law.

5. Payment

Unless otherwise stated on the quotation:

  • deposits are payable before work is scheduled or materials are ordered;

  • progress payments may be required for larger projects;

  • the balance is payable on completion or within the payment period stated on the invoice.

You must pay all undisputed amounts by the due date.

If you dispute an invoice, please notify us promptly and identify the amount and reason for the dispute. The undisputed portion remains payable.

For commercial customers, overdue amounts may incur reasonable debt-recovery costs where those costs have genuinely been incurred and are recoverable by law.

We may pause further work on an overdue account after giving reasonable notice, except where doing so would be contrary to law.

6. Project Timelines

Any commencement, production or completion date provided by MARKED. is based on the circumstances known at the time.

Timing may be affected by matters including:

  • artwork approvals;

  • customer changes;

  • material availability;

  • supplier delays;

  • weather;

  • site access;

  • vehicle availability;

  • third-party trades;

  • equipment failure;

  • illness or staff availability;

  • events outside our reasonable control.

We will take reasonable steps to complete work within agreed timeframes.

If no completion date has been agreed, services will be provided within a reasonable time as required by applicable law.

7. Customer Responsibilities

You are responsible for providing information that is accurate and reasonably complete, including:

  • contact and billing details;

  • vehicle make, model and condition;

  • site addresses;

  • measurements where supplied by you;

  • logos and artwork;

  • brand guidelines;

  • access requirements;

  • installation restrictions;

  • relevant deadlines; and

  • any special purpose or performance requirement that is important to you.

If you are relying on the signage or product for a particular purpose, you should tell us before accepting the quotation so we can assess whether the proposed solution is appropriate.

You must have authority to approve the work and to authorise installation on any vehicle, building, property or other asset involved in the project.

8. Artwork and Design

Where MARKED. prepares artwork or concepts, drafts will be supplied for approval where appropriate.

You are responsible for carefully checking artwork before approval, including:

  • spelling;

  • phone numbers;

  • email addresses;

  • website addresses;

  • pricing;

  • dimensions;

  • colours;

  • logos;

  • layout;

  • quantities; and

  • other factual information.

Once you approve artwork for production, MARKED. may rely on that approval.

If an error appears in the finished product because the approved artwork contained that error, the cost of reproducing or reinstalling the work may be charged to you, provided the finished product accurately reflects the artwork you approved.

This does not apply where the error was introduced by MARKED. after your approval or where the Australian Consumer Law provides otherwise.

9. Changes After Approval

Changes requested after artwork approval, materials have been ordered or production has commenced may result in additional charges and changes to the completion date.

We will obtain your approval for any material additional cost before proceeding with the variation where reasonably practicable.

10. Colour and Material Variation

We take reasonable care to achieve an accurate and consistent result.

However, some variation may occur between:

  • computer screens and physical print;

  • previously installed and newly produced materials;

  • different production batches;

  • different substrates;

  • printed and solid-colour vinyl;

  • samples and final production.

Where precise colour matching is critical, you should tell us before production begins so appropriate colour-matching methods or physical samples can be considered.

Minor variations that are normal for the relevant material or production process are not necessarily defects.

Your rights under the Australian Consumer Law are not affected.

11. Vehicle Wraps and Vehicle Graphics

Before presenting a vehicle for installation, you should ensure that it is reasonably clean, accessible and free from loose items that interfere with the work.

We may ask that a vehicle not be recently waxed, polished or treated with products that may interfere with adhesion.

Vehicle wraps and graphics rely on the condition of the surface to which they are applied.

You must tell us about any known:

  • respray;

  • paint repair;

  • panel replacement;

  • rust;

  • clear-coat failure;

  • paint damage;

  • ceramic coating;

  • protective coating;

  • bodywork repair; or

  • other condition that may affect adhesion or removal.

We may inspect a vehicle before installation, but an inspection may not reveal all underlying paint or surface conditions.

Where an existing paint finish is damaged, deteriorated, improperly repaired or has poor adhesion, applying or removing vinyl may reveal or contribute to existing paint failure.

Nothing in this clause excludes liability where loss or damage results from our failure to exercise due care and skill.

12. Existing Signage and Graphic Removal

Removal of existing vinyl, adhesive, signage or graphics may reveal:

  • fading;

  • paint differences;

  • adhesive residue;

  • existing surface damage;

  • corrosion;

  • previous repairs; or

  • differences in weathering.

Where these conditions were not reasonably apparent before work commenced, additional remediation may be required.

We will discuss any material additional work or cost with you before proceeding where reasonably practicable.

13. Site and Installation Conditions

You must provide reasonable and safe access to the installation site at the agreed time.

Unless included in our quotation, additional costs associated with matters such as the following may result in a variation:

  • difficult or restricted access;

  • working outside agreed hours;

  • traffic control;

  • permits;

  • inductions;

  • elevated work platforms;

  • scaffolding;

  • electrical work;

  • unforeseen structural conditions; or

  • delays caused by the site not being ready.

You are responsible for identifying known site-specific hazards or access restrictions that may affect our work.

MARKED. may suspend work where we reasonably consider conditions unsafe.

14. Electrical, Structural and Specialist Work

Where a project requires licensed electrical, building, engineering or other specialist work outside our scope, that work may need to be carried out by an appropriately qualified contractor.

Unless expressly included in our quotation, approvals, engineering certification, structural assessment, electrical work, planning approval, landlord approval and similar third-party services are the customer's responsibility.

We will not knowingly undertake work for which a licence or qualification is legally required unless it is performed by an appropriately authorised person.

15. Customer-Supplied Artwork and Intellectual Property

You warrant that you have the necessary rights or permission to provide and authorise us to reproduce any:

  • logo;

  • photograph;

  • illustration;

  • artwork;

  • trade mark;

  • wording; or

  • other material

that you provide to us.

You must not knowingly instruct us to reproduce material that infringes another person's intellectual property rights.

You remain the owner of intellectual property you supply to us.

16. MARKED. Design Work

Unless otherwise agreed in writing, MARKED. retains ownership of original concepts, design files, production files, templates and working files created by us.

Once all amounts relating to the relevant project have been paid, you may use the final supplied design for the purpose for which it was commissioned.

Transfer of editable artwork, source files or broader intellectual property rights must be separately agreed where required.

17. Photography and Portfolio Use

We may photograph completed work and use those photographs to showcase our workmanship on our website, social media, capability statements and marketing materials.

We will not knowingly disclose confidential commercial information when doing so.

If a project is confidential or you do not want it photographed or published, please tell us in writing before completion.

For major corporate, confidential or unreleased brand projects, we may seek permission before publication.

18. Subcontractors

MARKED. may use suitably skilled employees, installers, suppliers or subcontractors to complete part of a project.

MARKED. remains responsible for the services we have contracted to provide to you, subject to these Terms and applicable law.

19. Product Life and Maintenance

The useful life of signage, wraps and graphics varies depending on factors including:

  • material selected;

  • orientation;

  • UV exposure;

  • weather;

  • vehicle use;

  • cleaning methods;

  • environmental conditions;

  • installation surface; and

  • maintenance.

Any specific expected lifespan or manufacturer's warranty referred to in a quotation is an estimate or manufacturer's warranty subject to its applicable conditions, unless expressly stated otherwise.

You should follow any care or maintenance instructions we provide.

No stated manufacturer or voluntary warranty limits your rights under the Australian Consumer Law.

20. Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where the Australian Consumer Law applies, among other rights:

  • goods must meet applicable consumer guarantees, including acceptable quality and fitness for an applicable disclosed purpose; and

  • services must be provided with due care and skill, be fit for an applicable disclosed purpose and, where no time is specified, be supplied within a reasonable time.

Your rights under the Australian Consumer Law are in addition to any voluntary warranty we provide.

Nothing in these Terms is intended to exclude, restrict or modify those rights.

21. Problems With Our Work

If you believe there is a problem with goods or services we have supplied, please contact us as soon as reasonably practicable and provide details of the issue.

Where appropriate, we may request photographs or an opportunity to inspect the work.

If the goods or services fail to meet a guarantee or obligation that applies under the Australian Consumer Law, we will provide the remedy required by law.

Nothing in these Terms requires you to accept a remedy that is inconsistent with rights you have under applicable legislation.

22. Cancellation and Rescheduling

If you need to cancel or postpone a project, please notify us as soon as possible.

Where cancellation occurs after work has commenced or commitments have been made, you may be responsible for reasonable costs already incurred, including:

  • completed design work;

  • custom-produced goods;

  • materials ordered specifically for the project;

  • non-refundable third-party costs; and

  • labour already performed.

We will take reasonable steps to minimise avoidable loss.

Any cancellation fee will be proportionate to the reasonable costs or loss arising from the cancellation and will not apply where prohibited by law.

If MARKED. cancels a project and cannot provide the contracted work, amounts paid for work not supplied will be refunded as required by law.

23. Delays and Events Outside Reasonable Control

Neither party will be responsible for delay caused by circumstances outside that party's reasonable control to the extent permitted by law.

Where such an event occurs, the affected party should notify the other party and take reasonable steps to minimise the impact.

This clause does not exclude obligations or remedies that cannot lawfully be excluded.

24. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded or restricted.

To the extent permitted by law, MARKED. is not responsible for loss caused by:

  • inaccurate information supplied by you;

  • unauthorised artwork provided by you;

  • pre-existing defects in a vehicle, building or installation surface;

  • acts or omissions of third parties outside our reasonable control; or

  • use of goods contrary to instructions or for a purpose that was not disclosed to us.

Any limitation in these Terms applies only to the extent it is reasonably necessary to protect our legitimate business interests and permitted by applicable law.

25. Website Information

We take reasonable care to ensure information on this website is accurate and current.

However, website information is general in nature and may change without notice.

Photographs, mock-ups, colours and examples on the website are illustrative and may not precisely represent the appearance of a finished product.

A website enquiry does not create a contract or guarantee availability, price or a particular completion date.

A binding agreement arises only when a quotation or other offer is accepted.

26. Website Use

You must not use this website:

  • unlawfully;

  • to interfere with its operation or security;

  • to introduce malicious code;

  • to attempt unauthorised access to systems or data;

  • to impersonate another person; or

  • to reproduce our content in breach of intellectual property rights.

We may restrict access to the website where reasonably necessary for security, maintenance or legal compliance.

27. Website Intellectual Property

Unless otherwise stated, the content of this website, including text, graphics, photographs, designs, branding and layout, is owned by or licensed to MARKED.

You may view and use the website for ordinary personal or business enquiry purposes.

You must not reproduce, publish, commercially exploit or substantially copy our website content without permission, except where permitted by law.

Third-party trade marks and branding displayed in project examples remain the property of their respective owners.

28. Third-Party Links

Our website may contain links to third-party websites.

Those websites are controlled by their respective operators. We are not responsible for their content, availability or privacy practices.

A link does not necessarily indicate endorsement of the third party.

29. Privacy

We handle personal information in accordance with applicable privacy laws and our Privacy Policy.

Information submitted through our website may be processed using third-party service providers used to operate our business, such as website hosting, customer management, accounting, communication and automation platforms.

Please refer to our Privacy Policy for further information.

30. Marketing Communications

We may send marketing communications where we have your consent or are otherwise permitted by law.

Electronic marketing communications will include an appropriate way to opt out where required.

You may unsubscribe from marketing communications at any time.

Operational messages relating to an enquiry, quotation, booking, installation, invoice or existing project are not necessarily marketing communications.

31. Electronic Communications and Acceptance

You agree that communications, quotations, approvals, invoices and other documents may be provided electronically.

Where permitted by law, electronic acceptance, including acceptance through an online system, email, electronic signature or payment of a deposit, may constitute acceptance of a contract.

32. Complaints and Disputes

If a concern arises, we encourage you to contact us first so we can attempt to resolve it promptly.

Contact:

MARKED. Branding & Signage
Email: hello@markedbrandingsignage.com.au
Phone: 0421 694 964

Both parties agree to make a genuine attempt to resolve a dispute directly before commencing formal proceedings where it is reasonable to do so.

This clause does not prevent either party from exercising a statutory right, contacting NSW Fair Trading or another regulator, or commencing urgent proceedings where necessary.

33. Australian Consumer Law and Unfair Contract Terms

These Terms are intended to operate consistently with the Australian Consumer Law.

If any provision would constitute an unfair contract term, unlawfully exclude a consumer guarantee or otherwise be unenforceable, that provision is to be interpreted or limited to the extent necessary to comply with applicable law.

If that is not possible, the affected provision may be severed without affecting the remaining Terms where the remainder can continue to operate.

34. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to a particular contracted project will generally be those provided or made available to you when that contract was formed, together with any variations subsequently agreed between us.

Changes published after a contract is formed do not retrospectively alter that contract unless:

  • both parties agree; or

  • the change is required by law.

35. Governing Law

These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth legislation.

Subject to any rights available under applicable law, the parties submit to the jurisdiction of the courts and tribunals of New South Wales.
